Ohio Man Sentenced for Disabling Emissions Controls on Diesel Trucks
Washington, DC...A Hamilton County, Ohio, man was sentenced to prison today for violating the Clean Air Act through an aftermarket scheme to disable the emissions control systems of diesel trucks.
Davis Owens, 34, of Cleves, was sentenced to serve 30 days in prison, seven months of home confinement and one year of supervised release. He had previously pleaded guilty to one count of aiding and abetting the tampering of a monitoring device required under the Clean Air Act.
According to court documents, Owens was the co-owner of Holderdown Performance and owner of Cincy Diesel Performance. In 2020, Owens entered a Consent Agreement and Final Order (CAFO) with the Environmental Protection Agency (EPA) regarding allegations that he and Holderdown had knowingly worked to bypass or “defeat” components that controlled emissions on heavy duty diesel truck engines. Research has shown that bypassing a vehicle’s emissions components can increase particulate matter 40 times, nitrogen oxides 310 times, carbon monoxide 120 times and non-methane hydrocarbons 1,100 times.
Owens paid a $7,500 civil penalty as part of the CAFO and agreed that neither he nor Cincy Diesel Performance would manufacture, sell or install defeat devices. Investigation revealed that Owens and Cincy Diesel Performance continued to sell and install defeat devices as well as emissions deleting computer software until February 2022.
Assistant Attorney General Todd Kim of the Justice Department’s Environment and Natural Resources Division and U.S. Attorney Kenneth L. Parker for the Southern District of Ohio made the announcement.
The EPA’s Criminal Enforcement Division and the Ohio Attorney General’s Bureau of Criminal Investigations investigated the case.
Senior Trial Attorney Adam Cullman of the Environment and Natural Resources Division’s Environmental Crimes Section prosecuted the case.

Diesel soot is a well documented toxin, the best change is a hybrid clean diesel electric vehicle.
All electric is the best, that is coming in the future. Tesla trucks already are in long haul fleets, other makers also.

That guy's problem was he did it as a business, sooner or later you get caught. My uncle showed me how to keep your catalytic converter on your vehicle but the inside is hollowed out. My Dodge Diesel gets close to 30 mpg and my wife's 4Runner is 28 mpg up from 15 mpg. No smog here so no sweat off my balls. 30 days in the pokey? I've saved thousands in fuel cost, I ain't worried. Besides, dodge diesels are famous for big balls of soot when you hit the pedal.

Corporate price gouging has not been a primary driver of U.S. inflation, according to research published Monday by economists at the Federal Reserve Bank of San Francisco.
While markups for motor vehicles and petroleum products did rise sharply during the 2021-2022 inflation surge, markups across the entire spectrum of U.S. goods and services have been relatively flat during the post-pandemic recovery, the bank's latest Economic Letter showed.
"As such, rising markups have not been a main driver of the recent surge and subsequent decline in inflation during the current recovery," wrote the bank's research chief Sylvain Leduc and colleagues Huiyu Li and Zheng Liu.
Inflation by the Fed's targeted measure, the year-over-year change in the personal consumption expenditures price index, peaked at 7.1% in June 2022 and has since fallen, registering 2.7% in March.
U.S. President Joe Biden has blamed corporate greed for still-elevated prices, accusing companies of boosting profits by shrinking portion sizes but leaving the selling price unchanged, and by failing to pass on falling costs to consumers.
Fed policymakers, and many economists, say the inflation surge can be better explained by the combined effect of supply chain disruptions and a drop in labor supply during the post-pandemic recovery that occurred just as consumer demand rose.
They attribute the recent easing in inflation to healing supply chains and a rise in immigration that has added to the supply of workers, along with cooling demand amid higher borrowing costs as the Fed raised its policy rate.
Leduc and his colleagues did not refer to Biden or use the colloquial term 'greedflation,' but their work was a clear rebuttal of the theory that corporate profiteering has been a main cause of higher prices. Other economists, using different methodologies, have drawn similar conclusions.
"Data for the current recovery show that the increase in corporate profits is not particularly pronounced compared with previous recoveries," the San Francisco Fed researchers wrote. "Markups also have not played much of a role in the slowing of inflation since the summer of 2022."

Critics of President Biden are lambasting his beach vacation in Delaware while contrasting the Mother's Day weekend getaway to former President Trump's massive rally in the historically blue state of New Jersey on Saturday.
"Supporters camped out overnight at the beach for a Trump rally that starts at 5PM today in Wildwood. Joe Biden can’t fill up a broom closet without staff, media, and angry protesters (sic)," one X user under the name "Bad Hombre" posted Saturday.
Trump held a beachside rally in Wildwood, New Jersey, on Saturday evening as at least 80,000, and up to 100,000 supporters, joined the 45th president in the historically deep-blue state. Simultaneously, 24 miles across Deleware Bay, Biden arrived at his home in Rehoboth Beach for Mother’s Day.
Biden’s trip followed a fundraising event in Seattle, where he was greeted by local leaders such as Democrat Gov. Jay Inslee and Rep. Pramila Jayapal, D-Wash., as well as a group of left-wing anti-Israel protesters holding signs that read "Traitor Genocide Joe Free Palestine" and "Genocide Joe Must Go," the Seattle Times reported, adding that President Biden looked "Wiped Out" from the 2 hour ordeal citing it was due to being, jetlagged.
