SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS, COUNTY OF CALAVERAS, STATE OF CALIFORNIA, HELD ON
APRIL 6, 2010

PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russ Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Carol Gates, Supervising Board Clerk

1. Minutes of a regular Board of Supervisors meeting held on March 9, 2010 – approved, as written
2. Correspondence: March 12-17, 2010 – approved as processed
3. RESOLUTION recognizing April 2010 as Sexual Assault Awareness Month
4. MINUTE ORDER re: appointment of applicants to serve on Area 12 Agency on Aging, Emergency Medical Services Oversight Committee, Fish & Game Commission, and the Mental Health Advisory Board
5. RESOLUTION declaring April 2010 as Child Abuse Prevention Month
6. RESOLUTION approving award from the California Department of Boating and Waterways (DBW) Boating Safety and Enforcement Program Revenues for FY 2010/11
7. RESOLUTION authorizing approval of a site lease agreement utilizing a private communications tower, located on Sierra Vista Lookout Road, to install microwave communications equipment
8. MINUTE ORDER – a) approving the Substance Abuse and Crime Prevention Act (SACPA) County Plan and Offender Treatment Program (OTP) application in the amount of $46,226 for the period of July 1, 2009 – June 30, 2010; 2) approving the use of $5,136 in client fees for matching funds, and 3) authorizing the Behavioral Health Services Director to sign the agreement amendments, reports and certifications attendant to the program
9. Approval of a Universal Designation of Applicant’s Agent RESOLUTION for Non-State Agencies for Public Works
10. RESOLUTION implementing a Record and Retention Policy for First 5 Calaveras
REGULAR AGENDA
11. PUBLIC COMMENTS:
Bonnie Newman, Double Springs, requested clarification of the Brown Act. Chair Callaway responded.
Leslie Davis, Acting Assessor, announced a County website change – the implementation of a property look-out function to help property owners understand what is being done in terms of declines in value.
Colleen Tracy, Health Services Agency Director, announced that the first week in April is Public Health Week. She gave background information on the H1N1 flu response and thanked those responsible for related outreach strategies. Ms. Tracy invited everyone to participate in their Third Annual San Andreas Community Walk on Thursday, April 8, 2010.
Lyn Norfolk, Treasurer-Tax Collector, announced that since April 10, 2010 falls on a Saturday, the deadline for paying the second installment of property taxes without a penalty, is Monday, April 12, 2010 by 5:00 p.m. or postmarked by April 12, 2010. Ms. Norfolk referred to a Child Abuse Council flyer mailed with property tax statements. To date, approximately $14,000 of voluntary donations have been received for this year.
Karen Pekarcik, First 5 Calaveras, and Mickey Habbestad, CalWorks, informed of the submission of an application to attend a National Institute – they have been accepted and will be sending a team to Washington D.C. to look at child welfare national policies. They are the only small rural team accepted and the only CA team chosen to attend.
Don Smith, Copperopolis, CA referred to a 2 day, March 27th & 28th, 2010, Topsport Cycling Stage Race. He presented the Board with copies of a profile of the event.
Lee Shuemenke, expressed concern regarding Calaveras County’s permit process and fees associated with putting on the two day cycling events as an impediment. He asked for permission to amend their application to include a one day circuit race on Little John as a stand-along event on July 31, 2010. The County Planning Director will contact Mr. Shuemenke regarding associated fees.
Clyde Clapp, Valley Springs, CA expressed concern of the structure of County fees, including RIM fees.
Fred Kerr, Copperopolis, CA referenced a letter he sent to the Board in September, 2009,
regarding a noise ordinance. He suggested increased patrol on Lake Tulloch.
Bonnie Newman, Double Springs, CA referred to the County as treading water relative to the availability of services for our senior population and the disabled.
Joe Kelly, Angels Camp, CA spoke of the Board sitting as the Board of Equalization and exercising judicial powers delegated to it by the California Constitution, with special expertise in property valuation. He questioned, what is progressive real estate appraisal and property tax experience?
12. Discussion and possible action re: the adoption of an ORDINANCE adopting amendments to Calaveras County Code 8.06 Public Abatement – Property Maintenance Code; – approved 5-0
13. Discussion and possible action re: RESOLUTION rejecting all bids received for the American Recovery and Reinvestment Act of 2009 (ARRA), preventative maintenance project opened on February 26, 2010, on behalf of Calaveras County – approved 3-2-0; NOES: Supervisors Wilensky and Tryon
14. Discussion and possible action re: cont’d Public Hearing re: 2010-005 for Tentative Subdivision Tract Map for Novogradac Investment – continued indefinitely
15. Board discussion and direction regarding contracting with governmental relation firms to assist Calaveras County in securing federal funding for large infrastructure grants and capital projects - Callaway did not support discussing the use of general fund contingency money until Budget Hearings. She did support having priorities established before budget hearings. The Board was unanimous in supporting a May 4, 2010 study session for the determining of priorities.
16. Review of correspondence, reports and various matters of concern.
Next week, Supervisor Tofanelli will attend a Mountain Valley Medical Services Agency meeting regarding voting on ambulance service contracts – the meeting will be at the Copperopolis Fire Station; referenced his attendance last week, along with Counsel Jones, for a Joint County Summit in Fresno, regarding the Williamson Act.
Supervisor Thomas will attend a Central Sierra Planning Council & EDD meeting tomorrow morning in Jackson; referred to campaign candidate’s nights this week – Thursday at Saddle Creek and Friday at LaContenta; Saturday will attend a Calaveras Wine Alliance First Annual Tri Tip Shoot-Out event in Murphys.
Supervisor Wilensky will attend a Mental Health Advisory Board meeting this afternoon; tomorrow, a Amador/Calaveras Consensus meeting in Amador County followed that evening a Friends of the Rail Road Flat School meeting; Thursday will participate in the Community Health Walk at Government Center; the Copperopolis Candidates Night; Friday, will entertain Congressman Lungren for a forest tour including the Cultural Native American Culture Site Restoration being done by CHIPs and the national forest; announced receiving a resignation from the Chair of the Mental Health Advisory Board; the annual Mental Health report will be presented before the Board by the end of this month; spoke regarding the conversion of the Ione Power Plant and the possible threat of litigation.
Supervisor Tryon will attend this Wednesday’s Council of Governments (COG) meeting; referred to yesterday’s meeting with the Bureau of Reclamation held in Folsom.
Chair Callaway will attend a Property Owners Council meeting this week; Wednesday, a Law Library meeting followed by a COG meeting that evening; will meet with Senator Wolk on Friday; announced an olive oil opening event in Murphys on Friday; announced a traffic advisory re: state Route 26 between the junction of State Route 49/Mokelumne Hill to just east of the passing lane at Alabama Hill – motorists should expect 20 minute delays.
CAO Boyce had nothing to bring before the Board at this time.
Counsel Jones spoke of a meeting yesterday with Mr. Finnegan, the Folsom/Area Director for the Department of Reclamation. He referred to a request to prepare for Board signature, a formal request, for a scoping session. Jones will confer with CAO and bring the matter back to the Board, on a future agenda, for further discussion.
17. A STUDY SESSION was held re: Noise Ordinance with the Sheriff & Planning Departments
18. CLOSED SESSION: pursuant to Government Code section 54956.9: conference with legal counsel re: existing litigation – (three cases) – Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35775; Michael Nemee and Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV35721; Michael Nemee & Michelle Nemee v. County of Calaveras, Calaveras Superior Court Case No. CV36297; County Counsel – Board action: The Board authorized by an unanimous vote for an appropriation to County Counsel-Professional and Specialized Services with a draw on contingency of $15,000 to pay for the services of Kronick, Moskovitz, Tiedemann & Girard in Nemee v. County of Calaveras cases.
19. CLOSED SESSION: pursuant to Government Code section 54956.9; conference with legal counsel re: existing litigation – (one case) Alan W. Claudino v. County of Calaveras, et al; Calaveras Superior Court case No. CV35667; County Counsel – Board action: continued for 1 week, to the meeting of April 13, 2010
20. CLOSED SESSION: pursuant to Government Code section 54957.6; Conference with Labor Negotiators: SEIU, DSA, CCPSEA – Director Human Resources & Risk Management – Board action: nothing to report
