Summary of Tuesday July 8, 2008 BOS Meeting Video and Summary

San Andreas, CA....We have the Full Video and Official Summary of Tuesday's Board of Supervisor's meeting enclosed. This is the meeting that had everyone's attention for the better part of the week.




SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON JULY 8, 2008


PRESENT: Steve Wilensky, Chair; Russ Thomas, Vice-Chair; Bill Claudino, Merita Callaway and Thomas Tryon, Supervisors; David Sirias, Assistant County Counsel; Robert Lawton, County Administrative Officer; and Madaline Krska, Deputy Clerk

Discussion and possible action re: RESOLUTION authorizing Public Access Studio to hire Joan Lark for the position of part-time extra-hire office manager; Human Resources - Board action: approved 5-0
R E G U L A R A G E N D A
PUBLIC COMMENTS: The following persons addressed the Board with concerns regarding the Calaveras County Grand Jury 2007-2008 report as it relates to the Community Development Agency:
Jeff Davidson, spoke on behalf of the Calaveras County Chamber of Commerce including submission of documentation for the record; Mike Borean, spoke representing the Builders Association; Kristi Borean, Angels Camp spoke; Mike McAtee, Arnold spoke; Dave Haley, spoke representing Castle & Cook, Copperopolis; Mark Greaton, building contractor, Copperopolis spoke; Betsy Duncan, Copperopolis spoke; Chris Williams, San Andreas spoke; Deena Guido, Murphys spoke;
The following persons addressed the Board with various concerns and issues:
Cynthia Trade, spoke regarding vacation rentals and the proposed noise ordinance;
Joyce Techel, MyValleySprings.Com, spoke and submitted for the record, a community baseline report for Valley Springs;
Robert Kern, Vallecito, spoke with concerns regarding the proposed flood damage prevention ordinance; Darcy Zimmerman, Vallecito, spoke with concerns regarding the proposed flood damage prevention ordinance;

Bill Schmiett, Mountain Ranch, spoke regarding beginning a process for a County wide ordinance to address the sale and use of fireworks;
Terry Baker, Rail Road Flat, spoke referencing ongoing issues with a neighbor that has continued to increase the number of birds on their property despite court rulings. An appointment was scheduled today with Assistant County Counsel Sirias; Joe Kelly, spoke with concerns regarding the cancellation of today’s Legal Access Committee meeting; Supervisor Tom Tryon thanked the Grand Jury for their report, but expressed disappointment that they had not hired professional investigators and did not issue an interim report. He then released his complaint previously presented to the Grand Jury. Supervisor Callaway addressed concern regarding time frames and protocol for responses to the Grand Jury report and encouraged due process. Supervisors Thomas, Claudino and Wilensky also presented their individual comments.
Discussion ensued regarding time frames, protocol and due process. County Counsel will submit clarification regarding the same.
Discussion and possible action re: Measure J Bonds - adopt a resolution prescribing the terms and authorizing the issuance of bonds of the County; approving forms of and authorizing execution and delivery of a Paying Agent Agreement; a Bond Purchase Agreement, an Official Distribution of the Official Statement and Sale Documents; and authorizing execution of necessary certificates; Administration - Board action: approved 5-0
PUBLIC HEARING and possible Board action re: assessment ballot proceeding for County Service Area No. 2 (Bar XX); Public Works - Board action: no action required
PUBLIC HEARING and possible Board action re: assessment ballot proceeding for County Service Area No. 4 (Diamond XX); Public Works - Board action: no action required
Discussion and possible action re: MINUTE ORDER to approve a revised second amended Joint Powers Agreement creating the Upper Mokelumne River Watershed Authority; Supervisor Wilensky - Board action: approved 5-0
Discussion and possible action re: the adoption of an ORDINANCE approving revisions to Chapter 15.06 Flood Damage Prevention; Community Development Agency - Board action: approved 5-0 to continue as a study session on August 12, 2008
Review of correspondence, reports and various matters of concern.
Supervisor Tryon referenced safe and sane fireworks not being the cause of the current fires in the state. Tryon stated that the cause of some recent local fires was due to illegal fireworks, not from those being sold by local fundraising projects.



Supervisor Thomas referenced communication from Michael Neale, a professional photographer, who has offered his services to take photographs of the Board of Supervisors. These photos would replace the ones currently on the County’s web site. Supervisor Thomas expressed his willingness to accept this offer. Direction was given to CAO Lawton to make the arrangements with the photographer.

Supervisor Thomas, on Wednesday will attend the Calaveras County Arts Council’s Music in the Parks in Angels Camp at Greenhorn Creek. On Friday will attend the Calaveras County Chamber sponsored Economic Development Summit.

Supervisor Callaway asked CAO Lawton to provide a report from Vali & Cooper when it arrives at the Administrative Department. Supervisor Callaway on Wednesday, will be in Sacramento for the State Water Plan, as the representative from CSAC. On Saturday will be at Hermit Valley in Alpine assisting at a booth for the Death Ride. Supervisor Callaway discussed, with Supervisor Tryon, an event at the Avery Middle School on Saturday.

Supervisor Claudino had nothing to report.

Chair Wilensky referenced communication from Mary Sawicki, Director Calaveras Works and Human Services, regarding the current high temperatures being experienced. Adult Protective Services is checking on clients who are receiving in home supportive services to insure of their plans and needs for keeping cool. There are fans at the San Andreas location and the out stations for distribution. Water will be purchased for distribution as needed and requests for repairs to cooling systems will be addressed individually. The location of cooling centers will be forwarded to local radio stations.

Mike Walker, Sheriff’s Department, stated that daily conference calls are being held with the State OES to coordinate for the response to the heat and related concerns.

Chair Wilensky, on Wednesday, will attend a CHIPS Board meeting; Friday, will attend the Economic Development Summit, Monday, a Paloma Community meeting.

David Sirias, Assistant County Counsel, immediately following today’s agenda, will meet with concerned citizens of a Rail Road Flat neighborhood regarding two court cases for chickens and roosters that are being raised by a neighbor. Sirias will then meet with the CAO and Chair regarding a legal matter.

Supervisor Thomas referenced Bill Schmiett’s comments during Public Comment regarding the issue of fireworks sale and usage in the County. Supervisor Thomas has received many comments from public members regarding this topic. The sale of fireworks as a fundraiser for many groups is a concern. Supervisor Thomas proposed a Board sponsored fundraising event to be held to supplant the lack of funds with proceeds to be divided among the groups affected by a ban on the sale of fireworks.





Supervisor Callaway feels the issue is not from a fundraising standpoint but from the aspect of an ordinance and the expected enforcement. Supervisor Callaway proposed that all fire districts request the Board of Supervisors to initiate an ordinance banning fireworks and offer their support. Supervisor Callaway stated concerns for producing an ordinance without the mechanics of enforcement and support from a partnership with the fire districts.

Board support was given to have the Chair meet with the fire chiefs to get their input on this issue.

Supervisor Tryon reiterated his thoughts regarding the sale and usage of safe and sane fireworks not being the cause of the current fires.

Supervisor Claudino, feels that the sale and usage of safe and sane fireworks is not the cause of fires but the use of illegal fireworks being the cause. Supervisor Claudino expressed concern for the fundraisers for various groups that depend on these venues to generate revenue.

Chair Wilensky asked for contact to be made to obtain a list of groups that have used this method for fundraising.
