SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON SEPTEMBER 9, 2008


PRESENT: Steve Wilensky, Chair; Russ Thomas, Vice-Chair; Bill Claudino, Merita Callaway and Thomas Tryon, Supervisors; James Jones, County Counsel; Robert Lawton, County Administrative Officer; and Madaline Krska, Deputy Clerk

C O N S E N T A G E N D A

MINUTES of a regular Board of Supervisors meeting held on August 26, 2008 - Board action: approved 5-0
CORRESPONDENCE: August 20 - 28, 2008 - Board action: approved 5-0
RESOLUTION adopting Traffic Order No. 302 and establishing traffic control devices for Murphys Grade Road, Murphys; Bret Harte Drive, Murphys; Main Street, Murphys; Leary Court, Valley Springs; Bald Mountain Road, West Point; and Hartvickson Lane, Valley Springs; Public Works-Board Action: approved 5-0
RESOLUTION establishing a Sheriff's Jail Improvement Designated Fund; Administration - Board action: approved 5-0
RESOLUTION approving the Calaveras County Child Welfare Services System Improvement Plan for May 3, 2008 through May 2, 2011; CalWORKs - Board action: approved 5-0
MINUTE ORDER accepting scholarship assistance, in the amount of $3,200.00, from the California State Library for library staff to attend the Association of Small and Rural Libraries Conference, on September 19-21, 2008, in Sacramento and allow the Central Library to be closed Friday and Saturday, September 19 -20, 2008 for this purpose; Library - Board action: approved 5-0
R E G U L A R A G E N D A
PUBLIC COMMENTS: Gary Caldwell, Valley Springs, spoke referencing the concern he had previously expressed regarding access to public documents. He expressed appreciation for the County employee Loretta, Human Resources Department for her assistance in public records copies. Caldwell referenced a recent Board agenda item regarding a sign in Murphys. Caldwell expressed frustration regarding the Board not utilizing the advice of County Counsel.
Daryl Rusk expressed appreciation to the Sheriff’s Department.
Donna Schantz, San Andreas spoke regarding two community events: the 15th annual Calaveras Grape Stomp and Street Faire in Murphys on October

4th; A taste of Calaveras hosted by the Angels Camp Business Association to promote and premier Calaveras wineries, restaurants, caterers artists and musicians.
Tim McSorley, Director COG, spoke referencing a notice letter for the success in receiving a base transportation planning grant application. The grant for the Valley Springs community is $204,000, with matching funds from COG for a total project cost of $250,000. The Council of Governments was also successful in a $40,000 grant application to prepare the short range transit plan for the transit system. McSorley stated that the grants are under the community based transportation planning grant title. They can be used for land, use as it relates to transportation, smart growth types of principals which will be further defined, after the implementation of a steering committee, a consultant and community input.
Joyce Techel, Valley Springs, expressed pleasure for obtaining the grant.
Discussion and possible action re: General Plan Update - Board input and direction to staff regarding the draft Issues and Opportunities Report and the draft Working Vision Statement and Guiding Principles document (continued item from 08/05/2008 and 08/26/2008); Community Development Agency/Planning Department - Board action: direction was given for staff to return after taking into consideration the goals and objectives that were expressed by the Board and the community.
Discussion and possible action re: the introduction of an ordinance to establish regulations for activities on Tulloch Reservoir to ensure the quality of the reservoir as a resource for homeowners, public recreation, fisheries, and a power generation drinking supply; (continued item from 08/12/2008) Community Development Agency/Planning Department - Board action: introduction approved, as amended, stating that the County may process an application, but not issue a building permit until an encroachment permit has been issued by Tri-Dam.
10. Review of correspondence, reports and various matters of concern. Supervisor Tryon is unable to attend LAFCO next week and Supervisor Callaway will attend as his alternate.
Supervisor Thomas made an announcement regarding a computer training program concerning broadband training that will be available to citizens of the County. The organization Zero Divide builds and strengthens the

capacity of underserved communities to help with emerging technology. The classes will be held at Bret Harte High School and early sign up and registration is encouraged for the 35 sessions. Supervisor Thomas will attend the LAFCO meeting on Monday.
Supervisor Callaway, on Monday, will attend the LAFCO meeting for Supervisor Tryon; Supervisor Callaway will attend a CSAC Board meeting and a Water Plan meeting in Sacramento; Supervisor Wilensky will attend Central Sierra Child Support for Supervisor Callaway; Supervisor Callaway announced that this week-end is the Ebbetts Pass Scenic By-Way annual passport event and encouraged the Board and public to attend.
Supervisor Claudino will attend the Behavioral Health Open House on Monday; encouragement was given to the Board to participate as individuals in the Senior Center’s Chili Cook-off benefit on October 25th. Supervisor Claudino asked for public support for this worthy cause.
Supervisor Wilensky will attend the Sierra Nevada Alliance Conference this week-end; on Monday will attend the Behavioral Health open house; will attend a community meeting regarding environmental issues and the Mokelumne River in District two.
Chair Wilensky read into the record a letter that Supervisor Callaway has drafted to the Governor. The letter requests a veto for Assembly Bill 2447 relating to denial of approval of subdivision maps in State Responsibility Areas. The Board is in support of this letter and gave approval for chair’s signature.
CAO Lawton had nothing to bring before the Board.
Counsel Jones had nothing to bring before the Board.
CLOSED SESSION: pursuant to Government Code section 54956.9(b)(1); conference with legal counsel; anticipated litigation - significant exposure to litigation (one case); County Counsel; Board action: no action
Discussion/review of Williamson Act Policies; Department of Agriculture; informational only.
