SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON 2010 DECEMBER 7, 2010

PRESENT: Merita Callaway, Chair; Thomas Tryon, Vice-Chair; Gary Tofanelli, Steve Wilensky and Russ Thomas, Supervisors; James Jones, County Counsel; Jeanne Boyce, County Administrative Officer; and Madaline Krska, Deputy Clerk

C O N S E N T A G E N D A
1. MINUTES of a regular Board of Supervisors meeting held on November 2, 2010 and MINUTES of a special emergency meeting held on November 29, 2010 - approved 5-0 2. CORRESPONDENCE: November 5–18, 2010 – approved 5-0 3. MINUTE ORDER authorizing Chair of the Board to sign the annual Certification Statement of the Composition of the Local Planning Council Membership – approved 5-0 4. MINUTE ORDER approving a Memorandum of Understanding (MOU) between Calaveras County and the Mokelumne Hill, Murphys, Ebbetts Pass, Jenny Lind, and Central Calaveras Fire & Rescue Protection Districts to transfer the title of water tenders from Calaveras County to the Fire Protection Districts, along with a BUDGET TRANSFER in conjunction therewith – approved 4-1 NOES Tryon 5. MINUTE ORDER authorizing the Health Services Agency Director to 1) sign the Agreement and Memorandum of Understanding with the California Department of Public Health, Office of AIDS for HIV/AIDS surveillance funds in the amount of $20,127 for the three year period of July 1, 2010 – June 30, 2013 and 2) sign amendments to the Agreement and other required certification forms and reports – approved 5-0 6. RESOLUTION accepting the canvass of the consolidated General Election held on November 2, 2010 and declaring certain candidates elected – approved 5-0 7. RESOLUTION amending Resolution No. 10-188 to include complete list of Central Committee Candidates declared elected – approved 5-0 8. MINUTE ORDER authorizing the Public Works Director to execute Grazing Lease Agreements between Calaveras County, Ray Alger, and Paul Houret for County property comprising a portion of “Rock Creek Buffer Zone” through June 30, 2015 – approved 5-0 9. MINUTE ORDER upholding Code Compliance Administrative Citation # 10-24, regarding Ronald and Nancy Milliken, authorizing abatement of all remaining code violations, and the assessment of a lien on the subject property for the recovery of Administrative Costs, Administrative Fines, and Abatement Costs - Continued to December 14, 2010 10. MINUTE ORDER upholding Code Compliance Administrative Citation # 10-25, regarding Federal Home Loan Mortgage Corporation C/O Wells Fargo Bank, authorizing abatement of all remaining code violations, and the assessment of a lien on the subject property for the recovery of Administrative Costs, Administrative Fines, and Abatement Costs – approved as amended 5-0 11. 13. PUBLIC COMMENTS: Franziska Schabram, Gilliam Road, expressed extreme concerns regarding the lack of road repairs on Gillam Road she uses to access her home and ranch business. Chair Callaway requested a meeting between Ms. Schabram, Supervisor Tofanelli and Public Works. Christa Thompson, Behavioral Health, announced discussion will be held at the Mental Health Board meeting today regarding medical treatment assistance and services for children. The Behavioral Health Department has been recognized by Natural Rural Health Care for the Career Ladder Program. Lynette Norfolk, Treasurer-Tax Collector, issued a public service announcement regarding the property tax payment deadline of 5:00 P.M., December 10, 2010 with post marks accepted and the location of the lock box. Bonnie Newman, Double Springs, referenced mental health services and the inability for her client to receive assistance and facility expenses. Ms. Newman made a postage donation request for IHSS workers. Joe Piccinini, Secretary, Fire Chief’s Association, expressed appreciation for Clay Hawkins, Chief Assistant County Administrative Officer. Reference was made regarding fire department districts permit fee waivers and a desire for the best possible service. Ron Randall, Valley Springs, referenced Gilliam Road and the ongoing concerns. Joe Kelly, expressed concerns regarding a letter from the County Administrative Officer to Terry Baker. Andy Ballantyne, District V, expressed concerns regarding the evolution of the various Valley Springs Community plans, the confusion surrounding these plans and grant funds used. The plan was not adopted by the people. Mike Wietrick, commented on a grant plan named Greater Valley Springs Area. Request was made for the plan to be brought to the Board for final plan approval. Darren Spellman, Rancho Calaveras, stated the item had been brought before the Board and voted on 4-1. Lora Most, Rancho Calaveras, has researched myvalleysprings.com, their mission and the grants they have received.Peter Racz, Valley Springs, expressed appreciation for the election turnout. Concerns were stated for contract expense with Mintier Harnish, LP, bonds, federal and state fund sources. Tonya Dausend, Burson, read into the record questions she submitted regarding the November 9th General Plan study session stating she has not been contacted. Ed Ballard, Captain, Sheriffs Department, announced the jail project ground breaking ceremonies, December 17th at 10:00 A.M. Supervisor Thomas, spoke regarding Mr. Racz’s concerns for the General Plan update. 14. Discussion and possible action re: RESOLUTION approving and prioritizing the FY 2011/12 Overall Work Program Project Submittals to the Calaveras Council of Governments – approved 5-0 15. Discussion and possible action re: the adoption of ORDINANCES (3) adopting the California Code of Regulations Title 24, 2010 edition and amending Title 154 and the California Building Code relating to the repair and reconstruction of damaged buildings and the placarding used to denote conditions relating to continued occupancy of buildings – approved 5-0 16. Discussion and possible action re: MINUTE ORDER adopting Plans, Specifications and Details for the Off Site Improvements for the Calaveras Adult Detention Facility and Sheriff’s Administration Building project and authorization to advertise the project and receive bids – approved 4-1 ABSTAINED: Tofanelli 17. Discussion and possible action re: MINUTE ORDER approving contract amendment for PSA Dewberry, in the amount of $50,446, for the preparation of Storm Water Pollution Prevention Plan for the Adult Detention Facility and Sheriff’s Administration Building – approved 5-0 18. Discussion and possible action re: MINUTE ORDER approving contract amendment to ENGEO, in the amount of $8,500, for supplemental geotechnical exploration – approved 5-0 19. Review of correspondence: Supervisor Thomas had nothing to report. Supervisor Tofanelli had nothing to report. Supervisor Wilensky will attend the following meetings: today the Mental Health Board; Wednesday Delta College, the proposed closing of the Preston Facility; Thursday, Fire Safe Council and Central Fire; Friday an awards ceremony; Saturday committee board and Central Fire; Sunday a Habitat for Humanity ground breaking ceremony; Monday JPA Central Sierra Child Support and Paloma Community. An award was received by the Amador Calaveras Consensus Project. The Amador Planning Commission approved the Buena Vista Power Plan and will be agendized for the Amador County Board of Supervisors approval in January. Supervisor Tryon will attend a COG meeting Wednesday which includes discussion regarding projects under the jurisdiction of the County. These projects need to be agendized for the Board of Supervisors discussion prior a COG meeting. Support was requested for a continuance of this COG agenda item to allow time for a Board of Supervisors study session. Board discussion was held regarding the request for a continuance with a poll of the Board resulting in 4-1 NOES: Callaway. Supervisor Callaway announced the following: the December 14th Board meeting will begin at 9:30 following the 8:30 reception honoring retiring County officials, newly elected officials will be sworn into office on December 20th 9:30 A.M. in the Sequoia Room, CalWorks Building and a luncheon and learning series for Medicare 2011 will be held by Area 12 Agency on Aging. Callaway will meet with the Central Sierra Child Support regarding details of the revised JPA, attend an Arts Council event, Council of Governments meeting and a meeting with the Board of realtors and County Administrative Officer Jeanne Boyce. CAO Boyce referenced the state budget, a special Legislative session and Governor-Elect Brown will call a state budget briefing. A majority of solutions for budget cuts being proposed will be with health services. County Counsel Jones had nothing to report. 20. A STUDY SESSION was held regarding an informational briefing - Countywide water issues and their relationship to the General Plan Update - resulting in nothing to report. 21. A STUDY SESSION was held regarding future Calaveras County Animal Services Facility – potential sites – resulting in nothing to report.
