SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS,
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON MARCH 1, 2011
PRESENT: Gary Tofanelli, Vice-Chair; Steve Wilensky, Merita Callaway and Darren
Spellman, Supervisors; James Jones, County Counsel, Jeanne Boyce, County
Administrative Officer and Diane Severud, Supervising Board Clerk
ABSENT: Thomas Tryon, District IV.
CONSENT AGENDA
Consent Agenda Items 5 and 6 were pulled by Supervisor Tofanelli on behalf of the
Public Works Department, Closed Session Item 17 was continued to the March 15
meeting and Items 9 and 10 were switched to address Item 10 before Item 9.
George Fry pulled Item 7 on the Consent Agenda.
The balance of the Consent
Agenda was unanimously approved on a motion by Supervisor Wilensky and a second
by Supervisor Callaway.
1. MINUTES of a regular Board of Supervisors meeting held on February 15, 2011
2. CORRESPONDENCE:
February 11 – 17, 2011
3. MINUTE ORDER authorizing a Release of the Remaining Balance of Inspection Fees
in the amount of $19,861.42 to Calaveras county Water District (permit number 18-
UE-10).
4. MINUTE ORDER approving Plans and Specifications for the project entitled ARRA
Preventative Maintenance II, dated June 2009.
5. MINUTE ORDER authorizing execution of Maintenance Agreement 10-08-001 FMA with
Caltrans for maintenance of Murphys Grade Road within the limits of modified
State Route 4. Item pulled.
6. MINUTE ORDER authorizing execution of Amendment A-2 to Cooperative Agreement
10-168 with Caltrans providing for the relinquishment of a portion of State Route
4 to the County of Calaveras. Item pulled.
7. RESOLUTION approving a Memorandum of Understanding between Orange County and
the County of Calaveras for return of monies advanced to Orange County
attributable to the cost of the Trial of the People v. Charles Chitat Ng.
Approved 4-0, Supervisor Tryon absent.
REGULAR AGENDA
PUBLIC COMMENTS:
Mark Jones and Joyce Techel, Burson, www.calaverascap.com,
reported that all meetings of the Planning Commission and Board of Supervisors
are posted on the website and archived. This is a free service to the County;
however, they are always looking for grants to fund the process and tax
deductible contributions.
Costs are $50 for Supervisors meetings and $25 for
Planning Commission meetings.
Jean McComber, Arnold, stated that she supports
the efforts to avoid disrupting the habitat of the Elderberry Longhorn Beetle and
wondered why the same amount of effort is not expended on behalf of our four
legged friends.
The conditions at the Shelter are not good due to budget cuts
and short staffing. She would like the Board to focus on the site selection for
the new Shelter.
Kelli Fraguero, Program Director of Resource Connection
Calaveras Crisis Center, introduced George Chimiklis, new executive director of
the Resource Connection.
Supervisor Wilensky thanked Kelli for her efforts on
behalf of the County during the process of hiring a new director.
Rita Downs,
Director of Behavioral Health, congratulated George Chimiklis on his new
position. Announced the two postings for the 30 day hearings for Mental Health
Services Act Hearing. There will be a Mental Health meeting at 4PM today.
Received grant funding for $369,500 to develop supportive housing for those in
the county with mental illnesses and are working with ATCCA to develop an MOU.

Christa
Thompson, Mental Health Services Coordinator, continued explaining the housing
development, stating that the goal is to have four to six units.
Stakeholder
input will be a part of the criteria for selecting the property.
She also
reported on the implementation of prevention and early intervention programs for

suicide prevention, student mental health in response to VA Tech shootings for
treatment at local universities and stigma reduction which is an attempt to
stabilize and normalize the issues facing mental health consumers.

George Fry, Angels Camp, stigma issue, friend established “Stamp Out Stigma”
which purpose is to campaign to stop the use of the term “mental health” and
replace with “behavioral health”. Ed Ballard, Captain, reported on the approval
received from the Department of Finance on the working drawings to go out to bid.
There will be an informational workshop on March 17 from 4-6PM for local vendors
and contractors at the San Andreas Library.
Bonnie Newman, Double Springs,
distributed over 200 newsletters for home care providers. She attended the In-
Home Support Services (IHSS) Advisory Board meeting yesterday
She again
suggested they donate their meeting stipend to her fingerprinting fund for
service providers.
She stated that there is still one vacancy on the IHSS
Advisory Board. Terry Baker, RailRoad Flat, commented he had written a letter to
the Attorney General, requesting a copy of the Brown Act.
He stated that he
would like the County to adhere to the Brown Act. In his opinion, the Ag Dispute
Resolution Committee is not following the Brown Act and that the Committee needs
to be eliminated.
9. PUBLIC HEARING and possible Board action re: Mitigated Negative Declaration,
Zoning Amendment, and Tentative Parcel Map for Julio & Cynthia Toldeo. Approved
4-0, Supervisor Tryon absent.
10. RESOLUTION recognizing Chad Roots for “30” years of service with the
Calaveras County Jail. Approved 4-0, Supervisor Tryon Absent.
11. MINUTE ORDER upholding Code Compliance Administrative Citation #11-01,
regarding David Gonzales, authorizing abatement of all remaining code violations
and the assessment of a lien on the subject property for the recovery of
administrative costs, administrative fines and abatement costs.
Approved 4-0,
Supervisor Tryon Absent.
12.
MINUTE ORDER upholding
Code Compliance Administrative Citation #11-02,
regarding Robert and Robbie Henderson, authorizing abatement of all remaining
code violations and the assessment of a lien on the subject property for the
recovery of administrative costs, administrative fines and abatement costs.
Approved 4-0, Supervisor Tryon absent.
13.
MINUTE ORDER upholding
Code Compliance Administrative Citation #11-04,
regarding Michael and Ceilia Blankenship, authorizing abatement of all remaining
code violations and the assessment of a lien on the subject property for the
recovery of administrative costs, administrative fines and abatement costs.
Approved 4-0, Supervisor Tryon absent.
14. Discussion and possible action re: appointment of applicants to serve on two
(2) Advisory Boards and two (2) Commissions.
Approved 4-0, Supervisor Tryon
absent.
15. Review of correspondence, reports and various matters of concern. Supervisor
Wilensky will be attending the meetings of the Sierra Nevada Conservancy Board,
First Five Commission, Mental Health Advisory Board and would like a
recommendation for a name change to reflect Behavioral Health, to come back to
the Board for approval.
He commented on the Mtn. Ranch Town Hall meeting
presentations from staff regarding concerns in their community such as budget
issues, jail size, etc. The District Attorney, Sheriff and Probation departments
gave presentations and were very well received. He commented on a film project
sponsored by the UC Davis Department for Regional Change.
12 kids were given
cameras in community of West Point and asked to give their perspective on the
community.
This will be the basis of a documentary, “Up from the Understory”,
airing March 9th at 7PM on KVIE Channel 6.
Supervisor Spellman stated he will
hold his normal community meeting hours, will attend the reconvened CSA 1 Rancho
Calaveras meeting and his support of the Calaveras High School Lady Reds
Basketball team playing at Tokay in Lodi for the Section Championship. He also

reported on the Brown Act class in Valley Springs and his hope that another will
be scheduled by the Taxpayers association. He also stated that he had received
an invitation for lunch on Lobbyist Day, March 15. Peter Racz, invited everyone
to the all day affair to express their ideas.
Supervisor Callaway will attend
the Ebbetts Pass Property Owners Council, Area 12 Agency on Aging, Arts Council
Opening for Students in Calaveras at the Arts Council 1-3 PM Saturday, April 12
and the Audit of Area 12 Agency on Aging. Supervisor Tofanelli will be attending
CCOG.
County Counsel Jones had nothing to report.
CAO Boyce reported on the
State Budget front, language that CSAC has been working on for the Constitutional
Amendment drafts being passed back and forth.
Continue to monitor realignment
proposals.
Madaline Krska, Clerk-Recorder, email from Electnet urgency
legislation to reimburse counties for election expenses, January 1, 2009 – April
19, 2011 for elections called for by the Governor.
She would like to have
authorization to write a letter to support this bill, as other counties are
doing. CAO Boyce stated that the usual protocol is to send letter to author and
copies to committee members and local representatives. The item was determined
to be an urgency item, to be acted on immediately by staff.

Supervisor Tryon absent. George Fry commented that the Calaveras County Office
of Education Trustees had met to discuss the opportunities to get more info out
to the public of the intricacies of education.
16. CLOSED SESSION: pursuant to Government Code Section 54956.9; conference with
legal counsel re: existing litigation; Arbitration – Winnifred Wilson v. County
of Calaveras – C.S.M.C. S. Case No. ARB-09-0392. Nothing to Report.
