SUMMARY OF THE MINUTES OF A REGULAR MEETING OF THE BOARD OF SUPERVISORS,
COUNTY OF CALAVERAS, STATE OF CALIFORNIA
HELD ON APRIL 26, 2011
PRESENT: Thomas Tryon, Chair; Gary Tofanelli, Vice-Chair; Merita Callaway and Darren Spellman, Supervisors; James Jones, County Counsel, Jeanne Boyce, County Administrative Officer and Diane Severud, Supervising Board Clerk.
ABSENT: Steve Wilensky, District II.
Item 4 pulled by Supervisor Tofanelli, Item 3 was pulled by Peter Racz and Item 5 was pulled by Joe Kelly. The balance of the Consent Agenda was unanimously approved on a motion by Supervisor Callaway and a second by Supervisor Tofanelli.
CONSENT AGENDA
1.MINUTES of a regular Board of Supervisors meeting held on April 12, 2011.
2.CORRESPONDENCE: March 31 – April 7, 201.
6.MINUTE ORDER approving agreement between Calaveras Sheriff’s Department and 39th Agricultural District for Fair law enforcement.
7.MINUTE ORDER approving award from the California Department of Boating and Waterways (DBW) Boating Safety for funding of the Calaveras County Sheriff’s Office marine Safety Unit for FY 2011/12 in the amount of $174,926.
3.RESOLUTION authorizing a professional services agreement between Calaveras County and Stantec Consulting Services, Inc., for professional engineering services associated with the Mountain Ranch Road Guardrail Improvement Project for an amount not to exceed $249,896.86. Approved 4-0-1, Supervisor Wilensky absent.
4.RESOLUTION approving a professional services agreement between Calaveras County and MRO Engineers, Inc., for engineering design services for the Jenny Lind Safe Routes to School project for an amount not to exceed $177,995 for a term to expire December 30, 2012. Approved 4-0-1, Supervisor Wilensky absent.
5.RESOLUTION adopting Plans and Specifications, and soliciting formal bids for construction of Phase I Closure of the Rock Creek Landfill. Approved 4-0-1, Supervisor Wilensky absent.
REGULAR AGENDA
6.PUBLIC COMMENTS: Pat Ross, Adult Literacy Program with the Library, announced the upcoming Library Fundraiser on May 6 and 7 at the San Andreas Library. There will be food, animals for adoption, car seat checks and book sales. Bonnie Newman, Double Springs, Reported on the caregivers workshop about medical marijuana. She distributed a survey from the Area 12 Agency on Aging regarding issues facing seniors to be addressed for the next four years. The Agency is the main one to address the issues facing older adults in the community. There is no adult day care in the three counties. Will Moore, Valley Springs, commented that he was present to defend the United States Constitution and constitutional government from destruction and replacement with a great evil. Privatizing Fannie Mae and Freddie Mac could create abandoned neighborhoods which would be detrimental to the county. Peter Racz, Valley Springs, stated that he was originally from Hungary and he would not like to see Socialism here. He reported that he gave testimony on the CARP Bill in Sacramento and had asked questions of legislators there about FEMA. Joe Kelly, Copperopolis, commented that he had attended the LAFCO meeting and spoke of land use restrictions issues, as well as, the matter of farm land disappearing in California. He further stated that he does not support the position of Supervisor Tryon. Tonja Dausend, Burson, stated her concern with the wording of the Earth Day Resolution and regarding the accusations of bullying the children attending the meeting that day. She continued that the adult advisor of the Calaveras High School Earth Club is a progressive and that she finds that very concerning. Lynette Ospital, Valley Springs, reported that the road to her property is in poor condition due to the use by large trucks traveling from the Nemee’s property nearby.

9.MINUTE ORDER authorizing the Chair to sign a letter to the United States Department of Agriculture (USDA) Wildlife Services terminating Cooperative Agreement No. 09-73-06-0249-RA effective July 1, 2011. Failed due to lack of a motion.
10.MINUTE ORDER approving low bid for Calaveras Adult Detention Facility and Sheriff’s Administration Building for transmittal to State of California for review and authorization to subsequent award and construction contract. Approved 4-0-1, Supervisor Wilensky absent.
12.Review of correspondence, reports and various matters of concern. Supervisor Tofanelli will attend the CMCAA meeting and reported that he had attended UMRWA where the discussion focused on the upcoming budget and the distribution of cost sharing among the member agencies. He expressed an interest to have East Bay Municipal Utility District pay a larger percentage and to possibly rotate the responsibility of providing legal counsel among the member agencies. Supervisor Callaway coordinated the supervisors participation in the May 10 Government Center Frog Jump and polled the supervisors for a name for their frog; Elderberry. Supervisor Spellman will be the frog handler for the event. She commented that the County does have a policy regarding local bidder preference for County funded projects. She continued that she will attend the following meetings: Fish and Game Commission, Treasury Oversight, Chamber of Commerce Mixer, SART fundraiser and Green Days at Ironstone. Supervisor Spellman stated that he would like to see the County establish an Acceptable Contractor List. He reported that he will attend the Unmet Transit Needs meeting at the Rancho Calaveras Clubhouse presented by Public Works and CCOG. He will also hold the Town Hall meetings that he promised during his campaign; one at the Black Creek Center in Copperopolis and the other at the Rancho Calaveras Clubhouse. Chair Tryon and Counsel Jones had nothing to report. CAO Boyce encouraged all to participate at the Government Center Frog Jump and Barbeque.
The meeting was recessed at 12:50 PM and reconvened at 2:00 PM.
11.STUDY SESSION: Informational discussion regarding Health Benefits (CSAC Excess Insurance Authority); Human Resources & Risk Management.
Adjourned at 3:20 PM.
