Trintas Still Chipping Out of the Rough ~By John Hamilton

Burson, CA...Bankruptcy judges have given the Nemees until May to present their civil case against the county. That Judge Sargis allowed the case to go forward was helped that a couple of witnesses had yet to be served. On a related issue we are hearing that the bank may have to re notice the sales. Short of that however Golf still continues on the troubled course on the west side of the county....



So the drama continues....now the center of the battle may shift to the future Supervisors and how they might lean on becoming the elusive 3rd vote that will allow the legally entangled project to become legal or be inclined offer a settlement.

The wild card in this is that Ironstone may get dragged kicking and screaming into land use issues in the county. The fact that Ironstone is obviously a working vineyard and fits the design of the county's agritourism ordinances works in their favor. Also in Ironstone's and by extension the Nemee's favor is that one cannot imagine that Calaveras County would have any wish to drag one of the premier venues and drawing cards of the only bright spot economically in our economy into a legal skirmish.

Tourism is becoming the lifeblood of Calaveras County and now how future supervisors may vote on these issues may become central to not only the case for the Trinitas but the business climate in Calaveras.

Central to the issue is whether the Nemees can make a convincing argument that their golfing and olive operation is analogous with wine, vineyards and concerts. They have failed so far to do so but oddly the Hail Mary attempt to drag Ironstone into the land use argument may finally be the lever that exerts enough pressure on the county to put them in a settling mood.

Supervisors and the County could absorb the pressure and costs of battling the Nemees. Can you imagine the public outcry if they try to entangle the county's premier venue and source of County pride into a legal battle?

So the seven year drama that is Trinitas groans on...
