Swat Call in Burson on May 29th, 2014

Burson, Ca...On 5-29-14 at 1700 hours, Deputies were dispatched to the 10000 block of South Camanche Parkway for a male subject shooting at propane tanks in the front of his residence. Deputies were able to identify the subject. Neighbors confirmed the subject was armed and was actively shooting prior to our arrival. Deputies immediately set up a perimeter around the residence and alerted neighbors. The subject had active warrants for his arrest and was a convicted felon prohibiting him from possessing a firearm...


On 5-29-14 at 1700 hours, Deputies were dispatched to the 10000 block of South Camanche
Parkway for a male subject shooting at propane tanks in the front of his residence. Deputies
were able to identify the subject as Lee Matthew Smith (31 years old). Neighbors confirmed the
subject was armed and was actively shooting prior to our arrival. Deputies immediately set up a
perimeter around the residence and alerted neighbors. Lee Smith had active warrants for his
arrest and was a convicted felon prohibiting him from possessing a firearm. After deputies
made several attempts, Smith refused to answer his door and phone. The Calaveras County
Special Weapons and Tactics Team (SWAT) were dispatched along with the Hostage
Negotiation Team (HNT). HNT attempted to contact the subject through use an of a PA system
for hours without success. Prior to SWAT making contact with Smith, he exited out the back of
the residence and attempted to flee. Deputies on the perimeter were able to make contact
with Smith and place him under arrest. The incident took about six hours and no injuries were
reported.

Lee Matthew Smith was booked into the Calaveras County Jail for Willful Discharge of a Firearm
in Grossly and Negligent Manner, Felon in Possession of a Firearm, Resisting and Delaying a
Peace Officer, Felon in Possession of Ammunition and Warrants, Bail total $42,500.

Shame on him for abusing innocent propane tanks. Thankfully, no aluminum cans were harmed during this unfortunate event.

Unfortunately , our "catch and release" D.A. will probably release this fish back into the gene pool like she has with so many others.

      Starts with the DA - they are supposed to represent the people.

      And your right she is not my DA as I voted against her.

      Hopefully more will do the same in the next election!

        her hands are tied with the restrictions the state sets. Where do you think she can house these criminals? county jail that is double the size but only staffed for what they can hold now? or the prison system that will release you much like the county system. Take it up with your State. it's higher than our DA

          Wrong on several counts.

          Her job is to secure convictions. Nothing more.
          - She is the voice and will of the people to secure
          orderly justice on our behalf.

          The state does not tie her hand in this pursuit.

          Judges and Juries determine sentences.

          Housing inmates is a State / County issue.

          The output of the system does not determine the input.

          Our Sheriff Kuntz and his deputies do a great job of rounding up the dirt bags and securing evidence to establish guilt.

          We need a DA to work with them to secure felony convictions when warranted.

          We need judges willing to sentence felons.

          And yes, we need to fix our penal system to keep the worst locked up for the longest time allowed by our legislature.

          While federal judges and the prison union work to gate the back end, it should not allow the gating of the front end.

          The conviction is what is truly important. The punishment meted out is a secondary issue.

          She is more interested in clearing cases than fighting for convictions. This is why she will not have my vote when it comes time to stand again for election.

            The US has the highest incarceration rate (716 prisoners per 100,000 people) in the world. If nothing else, that sounds expensive.
