Newbys Seek To Represent Themselves In Attempted Murder Case

San Andreas, CA...Yesterday the father & son allegedly bat wielding duo of Jeffrey Scott Newby (43 years old) & Mike Patrick Newby (18 years old) were arraigned on their charges in Judge Healy's courtroom. The defendants at times seemed almost unaware of the seriousness of the charges facing them. They refused council and sought to represent themselves in their upcoming attempted murder trial. Judge Healy had to eventually remove the father from the courtroom with his son so the father couldn't influence the son in a manner detrimental to his legal rights. After the father was removed the son still held to the belief that he should represent himself in court even after Judge Healy counseling him otherwise...

When the elder Newby was brought back into the courtroom he reiterated he wanted to represent himself and stated he was the victim in the case. He seemed confused though as he later mentioned he really just wanted to delay the decision on his representation until he had time to talk to his wife and a lawyer. He stated their phones had been taken and seemed unaware he could make phone calls from jail.

After these statements Judge Healy appointed council for the father anyway. The Judge stated that the father could still refuse council and represent himself at trial.

We may be mistaken but it appeared that neither the victim's or the defendants family or friends were in the gallery for their appearance.

Their lengthy first appearance seemed almost like courtroom tv and the pair really did not seem to realize the gravity of their alleged actions. Their next court appearance will be in a week.

Valley Springs Attempted Murder

On 3/29/2015 at approximately 1805 hours, the Calaveras County Sheriff’s Office responded to the 300 block of Paloma Road, in Valley Springs, for a report of a male subject being attacked by two men with baseball bats. Deputies arrived on scene and observed a 59 year old male who was covered in blood from an apparent head injury. Medical personnel tended to the victim’s injuries and requested an air ambulance to transport the victim to a valley hospital.

Deputies learned through witnesses on scene that two suspects, one wearing a ski mask and holding a baseball bat and another male threw something at the victim’s vehicle causing the victim to stop his vehicle. As the victim exited his vehicle the two suspects sprayed the victim with pepper spray and began to strike the victim repeatedly with the bat.

Witnesses overheard the attack and called the Sheriff’s Office to report the incident. The victim received significant and serious injuries as a result of the suspects’ actions with the bat.

On 03/30/15, The Calaveras County Sheriff’s Detectives served a search warrant on the 300 block of Paloma Road, in Valley Springs. Detectives placed Jeffrey Scott Newby (43 years old) and Mike Patrick Newby (18 years old) under arrest for attempted murder. The Sheriff’s Department does not have an update on the victim’s medical status. The investigation into the attempted homicide is ongoing. Both Jeffrey Scott Newby and Mike Patrick Newby were booked into the Calaveras County Sheriff’s Office Jail. Mike Patrick Newby was booked for attempted murder, conspiracy to commit a crime, and Illegal Use of Pepper spray, bail set at $1,003,750. Jeffrey Scott Newby is being held for attempted murder and conspiracy, bail set at $1,000,000.
