Kearney Recall Election To Move Forward & Filing Period Starts Today

San Andreas, CA...The Calaveras County Clerk Recorder and Registrar of Voters has issued an order to hold the recall election for the purpose of determining whether County Supervisor District 5, Steven Kearney is to be recalled and to fill the vacancy if the member is recalled; pursuant to Elections Code Section 11241 which states: “If the governing board fails to issue the order within the time specified in section 11240, the county elections official, within five days shall set the date for holding the election.” The proclamation and notice of election is attached. The filing period opens today July 27, 2016 and closes August 25, 2016, this closing filing period applies to candidates filing for the Supervisor District 5 contest only.

SPECIAL ELECTION PROCLAMATION
NOTICE OF RECALL ELECTION TO BE HELD IN THE COUNTY OF CALAVERAS SUPERVISORIAL DISTRICT 5 ON NOVEMBER 8, 2016

I, REBECCA TURNER, County Clerk-Recorder and Registrar of Voters of the County of Calaveras, State of California, hereby proclaim:

NOTICE IS HEREBY GIVEN, proponents have submitted a petition for the recall of Steven Kearney, Member of the Board of Supervisors of Calaveras County Supervisor, District 5. Sufficient signatures were obtained on the petitions for the recall election to proceed.

The Board of Supervisors was duly noticed by the Registrar of Voters at the meeting held on July 12, 2016, that pursuant to California Elections Code Section 11240 which states in part - Within 14 days after the meeting at which the governing body received the certificate of sufficiency, the governing body shall issue an order stating that an election shall be held pursuant to this article to determine whether or not the officer named in the petition shall be recalled.

The Calaveras County Board of Supervisors failed to issue an order stating that an election shall be held to determine whether or not the officer named in the petitions shall be recalled.

NOTICE is also hereby given, pursuant to California Elections Code Section 11241 which states in part - If the governing board fails to issue the order within the time specified in Section 11240, the County Elections Official, within five days, shall set the date for holding the election.

The Calaveras County Clerk-Recorder& Registrar of Voters, hereby issues the order on July 27, 2016 to hold the recall election for the purpose of determining whether Steven Kearney, Calaveras County Supervisor District 5, is to be recalled from office and to fill a vacancy if the board member is recalled. The election shall be held on Tuesday, November 8, 2016 pursuant to California Elections Code Section 11241.

For recalls of local officers, in accordance with the provisions of California Election Code, Section 11381, nomination of candidates to succeed the recalled officer shall be made in the manner prescribed for nominating a candidate to that office in a regular election.

NOTICE IS FURTHER GIVEN that the filing period opens July 27, 2016 and closes at 5:00 p.m. on August 25, 2016, after which time no declarations of candidacy will be accepted for filing. The hours for filing signatures in lieu, nomination papers and declarations of candidacy will be from 8:00 a.m. to 4:00 p.m. excluding holidays. On filing deadlines the office hours will be extended to 5:00 p.m. During this filing period nomination papers and declarations of candidacy can be obtained from the Elections Department, Government Center, 891 Mountain Ranch Road, San Andreas, CA.

The filing fee for this office is $563.06 based off of an annual salary of $56,305.50. In lieu of the filing fee, 529 signatures may be collected.

Candidate Statement of Qualifications must be presented during the filing period and an estimated, prepaid cost of $350 per candidate shall be collected at the time of filing.

No person whose recall is being sought may be a candidate to succeed himself or herself at a recall election nor to succeed any other member of the same governing board whose recall is being sought at the same election.
