68 Year Old Twain Harte Man Arrested In Twain Harte Shooting

Twain Harte, CA...Yesterday morning just after 9:30 AM, Sheriff Deputies responded to the 19000 block of Wanita Way in Twain Harte for a reported disturbance. A man called dispatch and reported he was a roommate at the residence and heard two gunshots after a disturbance between roommates, 68 year old Mark Leyva and 70 year old John Hodgins . The caller said he was outside of the home but the others were still inside. When deputies arrived on scene, Leyva exited the home and was detained. Leyva told deputies that Hodgins and Hodgins girlfriend, 67 year old Jeanne Guthmiller, were still inside and the woman had a gunshot wound to her leg.




Dispatch attempted to make phone calls to the home as deputies set a perimeter, notified surrounding neighbors and called out to the occupants inside as it was unclear who the shooter was or where they were located. The Tuolumne County Sheriff’s Office SWAT team responded to the home. Hodgins and Guthmiller eventually came outside after nearly an hour of announcements to exit the home were made. SWAT members searched the home to ensure the scene was safe. Hodgins had sustained a non-life threatening gunshot wound to his upper arm and several lacerations on his body and Guthmiller had a blunt force trauma injury to her leg. They were both transported to the Sonora Regional Medical Center for treatment.

During an interview with Leyva, he admitted that he and Hodgins had recently been arguing over household issues and as he confronted Hodgins with his Berretta 9mm pistol, they got into a physical altercation and he “pistol whipped” Hodgins. During the fight a couple of shots were fired. Leyva shot Hodgin’s iMac computer and his television. Leyva told both victims to hide in the bathroom and not to come out under any circumstance

Leyva was arrested and booked into the Tuolumne County Jail for assault with a deadly weapon, illegal discharging of a firearm, and false imprisonment.
