Calaveras Supervisors Vote to Work on Cannabis Regulation Ordinance...(Now With Supervisor Comments)

San Andreas, CA...After days of comments and testimony the Calaveras County Board of Supervisors voted to craft an even tougher regulatory ordinance than was part of the agenda today. So it looks like Legal Commercial Cannabis will probably survive in some form. The vote was 3-2 with Mills and Clapp casting the no votes.. Update...We have added the comments before the Supervisors Voted and Comments leading to instructions to staff....

Soil testing from outside lab, fencing, no grows within residential zoning, etc.

Details to follow...

What they have to gain? Millions of dollars in taxes collected.
Taxes you have been spared because of marijuana cultivation.
I bet you'll be complaining come Nov 1st when your gasoline 12 cents or diesel fuel 16 cents increases, for transportation (in other words, Gov Browns Bullet Train) a train 99% here won't be using.

So you think it ok to let me suffer because you don’t like the smell ? And your so self centered to let me suffer so let me ask do you think 6 plants of me medication upsets you when I can’t get out of bed because of pain I will say thanks to people like you will let me suffer and yes I’m in a street that has only 8 full timers and no one next to me full time and back in to a hill no other homes and I grow organic so you think I shouldn’t have any right to grow me own medication and if I go to a club it full of chemicals what’s wrong with this picture I will answer that you don’t care about me and that your self centered let me suffer thanks

Not talking about 6 plants, this is about commercial grows, which obviosly you dont need, cause your talking about six plants.....and its selfish of you to think that a homeowner who was here first should have to put up with nasty stinch so you can get you chemical high from weed, all in the guise of self medicating

            Reasoned Vote
Posted on: 2017-10-24 17:54:10   By: Anonymous

After the scathing rebuke of Supe Mills and his propaganda 'study", the majority chose a reasonable action- to draw up regulations, which will then fund enforcement, and abatement of illegal grows.
The legal growers allowed to grow should also help the Sheriff to stop illegal grows.
The alliance should hire competent intel people to view aerial images with parcel overlays, and give the info to the Sheriff. The illegal problem can be stopped with some smart efforts.
legal grows will be on large parcels, with an ample set back, and organic. All will be inspected 2x a grow season. marketing documents will also be kept and certified , sales only to certified buyers. Growers will have to send sales documentation to the county.

There are solutions, for everyone in Calaveras County, the Supervisors made the reasoned choice. Now the work of drafting regulation will begin, by the next growing season, they should be in place. Let's all work together to make this work for all.

All sounds great but for mandatory organic production.

That is, unless Calaveras County is planning to mandate ONLY organic production methods for every other crop grown in this county...

That's clearly a deprivation of due process and will certainly not survive the constitutional scrutiny that even a below-average 1L could provide...

Back to the drawing board on that point...

Come on folks, get real. Dennis Mills and Clyde Clapp chose to make this a culture war, when it should have been about the economy, the environment, and the best interests of the future of this County.

A straight-up ban was going to take this county down a perilous path of lawsuits and perhaps bankruptcy. Then the state would take over and open up the whole county to commercial grows.

Regulation was the intelligent alternative. Tofanelli was a real surprise in laying out strict conditions for regulation.

Now lets get back to building our county and not get distracted by things that don't make us great again!

Right. Tofanelli dodged the issue and was let off the hook by not having to vote on the ban, which was the only agenda item. Still, I can't imagine the growers being happy. That ordinance puts the vast majority of them out of business.

Bottom Line...Clapp is a spineless liar. He was caught with his pants down over his letter. Stevie Wonder could see that he didn't write it. When confronted with that fact he did in fact say he "had help". Why didn't his helper sign the letter also? Why didn't he admit he gleened info from Fuhrer Mills so called study? And finally, after the board broke per Olivera's instructions as this was all about to unravel, why didn't the subject of the lying, deceitful, piece of crap supervisor come up again when the meeting reconveined? He is an utter disgrace, and an embarassment to this county. He must go.

So, Bill McManus & Friends, you got hood winked. Gary Tofanelli played you all along. Tofanelli is the king of fence sitting, I know for a fact that he never had any intention of voting for a ban. His plan all along was to either send it to the voters or have an alternate ordinance drawn up, either way he wouldn't have to fulfill his promise made to you. But in doing so he got you to the printer to make up his flyers and on the streets pushing him back into office. He is the master of do nothing which is why he was voted out of office after his first term but I guess you forgot that. Even in a printed interview with him and the other two candidates when they had an opinion and took a stand on each point Gary had "No Comment" on nearly 50% of them. You got played and he's been laughing at you since last November, behind your back of course. He got you and your resources to put him in office, perhaps your only recourse is to use those same resources to get him out...

I must disagree back and will also be polite. One has only to look who funded his campaign for "re-election" and know what he was going to do. He was funded by the county employees labor union who would suffer layoffs if the cannabis money was not going to continue to come in. He was also supported by his friends Tryon (who he said he had lunch with before his vote and who is a registered grower) and Calloway, who has been stumping for legal growing in the county. If you thought he was going to vote for a ban, you thought wrong, he was going to do this all along and do his best to discredit the prior board by slamming the UO, which he did. Little Bill and Davey must be fuming.

Based on what was quoted and summarized in the press, I was surprised by the overall vote but, no, not by Mr. Tofanelli's. For the record, I'm in agreement. This county has more problems with meth, alcohol and lack of responsible parenting. Not to mention no revenue prospects on the horizon. Cannabis has been here for decades. Time to shine a light on it and acknowledge its existence with regulation and enforcement, the only way to reduce the violence and environmental degradation happening now.

kicking the can down the road, basically they did nothing. They sure have a lot of time to waste and sure as hell don't care about their constituents, thanks BOS. I know "your" dope dealers will contribute more dollars to you than we can as just plain hard working folks who pay their property taxes, good luck with their dirty money, mine will go to a county that doesn't contribute to the fall of our young into a lazy, non-productive life. Hope you feel good about yourselves when you go to bed at night BOS.
