MINUTE ORDER - authorizing the Chair of the Board of Supervisors to sign the Public Health Emergency Preparedness Centers for Disease Control and Prevention Agreement with the California Department of Public Health for the period Aug 31, 2007 - Aug 9, 2008; the "Certification Regarding Lobbying"; the "Non-Supplantation Certification; and authorizing the Health Services Agency Director to sign subsequent reports and forms related to this Agreement; Public Health Department - Board action: approved 5-0
MINUTE ORDER authorizing Board Chair to sign amendment 1 to Standard Agreement 07-0008, between Calaveras County and the California Department of Food and Agriculture, Pierce's Disease Control Program, for a new total not to exceed $97,071.00 for Fiscal Years 2007/08, 2008/09, 2009/2010, an increase of $1,824.00 for fiscal year 2007/2008; Environmental Management Agency/Department of Agriculture - Board action: approved 5-0
MINUTE ORDER authorizing Board Chair to sign Standard Agreement 06-0817, between Calaveras County and the California Department of Food and Agriculture, Pest Detection/Emergency Projects - Light Brown Apple Moth, not to exceed $3,452.90 for work performed in Fiscal Year 2006/2007; Environmental Management Agency/Department of Agriculture - Board action: approved 5-0
RESOLUTION adopting the addendum to a professional service agreement with MV Transportation for management and operation of Calaveras Transit; Public Works - Board action: approved 5-0
RESOLUTION authorizing a joint use agreement between Calaveras County and the Feeney Park Foundation for recreational use of a multipurpose facility, known as Feeney Park; Administration - Board action: approved 5-0
MINUTE ORDER to approve the distribution of excess proceeds from public auction held on November 16, 2006; Tax Collector-Treasurer - Board action: approved 5-0
RESOLUTION authorizing the Sheriff's 2007/2008 spending plan to be funded by the Supplemental Law Enforcement Services Fund; authorize the transfer of funds and the Auditor Controller to adjust the books of record accordingly; along with a BUDGET TRANSFER, in the amount of $14,904.10, in conjunction therewith; (requires 4/5 vote); Sheriff - Board action: approved 5-0

RESOLUTION approving agreement #07-77305-000 between the CA Department of Mental Health and Calaveras County Behavioral Health Services, for fiscal years 04-05 through 07-08, in the amount of $1,657,788, for implementation of the Mental Health Services Act Three-Year Program and Expenditure Plan and Plan Updates superseding Agreement #06-76375-000 previously approved by the Board per Resolution 07-116; Behavioral Health - Board action: approved 5-0
MINUTE ORDER to approve allocating, from District II discretionary funds, $500.00 for the Railroad Flat Community Club, for the purchase of a generator; Supervisor Wilensky - Board action: approved 5-0
R E G U L A R A G E N D A
PUBLIC COMMENTS: a) Chair Wilensky and Supervisor Tryon presented checks from the Department of Housing and Community Development, Home Investors Partnership Awards. A check of $800,000 for County first time home buyers and a $800,000 check for the City of Angles Camp with $200,000 for home rehabilitation and $600,000 for first time home buyers in the City of Angels. b) Tim McSorley, Executive Director, Council of Governments(COG) updated the Board on the progress for funding of the Wagon Wheel Project. This matter will be discussed further in the COG meeting tomorrow evening. Discussion was held regarding improvements for the intersection of Highway 4 and Pool Station Road. Plans are in place for this dangerous intersection for a left hand turn pocket and site distance improvements.
c) Christa Thompson, Behavioral Health Services, announced 3 public forums to be held. Information will be presented regarding state guidelines and County recommendations to determine how funds can be used in Calaveras County. Flyers were distributed to the Board members.
d) Brian Moss, Administrator, Environmental Management Agency, informed the Board of a recent presentation of $156,000 from the Carl Moyer Grant Program. Steve Case, of 7-11 Materials, is the recipient of this state program for retrofit or replacement regarding diesel emissions. The County will continue to apply throughout the year for these $200,000 grants.
e) Laura Sternick, flower vendor business owner from Copperopolis, spoke with concerns regarding an application for rezoning. Robert Sellman, Planning Director, took contact information to assist Ms. Sternick in her project.
Discussion and possible action re: RESOLUTION approving a revised and extended contract with Sheriff's Management Unit (SMU); Human Resources - Board action: approved 5-0
Discussion and possible action re: the introduction of an ordinance repealing and re-enacting Chapter 16.24 of the County of Calaveras Code establishing standards for dedications of land and/or payment of fees for Park and Recreation Facilities in conjunction with subdivision approval; Community Development Agency (continued item from 01/08/2008 and 01/22/2008) - Board action: introduction approved as amended to correct clerical errors, 5-0
Discussion and possible action re: MINUTE ORDER: first contract amendments - 1) approve a Professional Services Contract with Quad Knopf, Inc. for completion of 2004-114 ZA, TSTM The Ridge at Trinitas, EIR; and 2) approve the contract with applicants Mike and Michelle Nemee to reimburse the County for the costs of the Quad Knopf contract; and 3) approve a budget transfer, in the amount of $245,673.00, in conjunction therewith; (requires 4/5 vote) Community Development Agency (continued item from 01/22/08) - Board action: approved 5-0
Discussion and possible action re: MINUTE ORDER appointing applicants to various committees and commissions to serve under the jurisdiction of the Board of Supervisors - Board action: approved 5-0
Review of correspondence, reports and various matters of concern - a) Supervisor Tryon reported on a RCRC meeting that he attended. Discussions were held regarding a potential surcharge on insurance policies. Supervisor Tryon stated discussion was also held concerning the Governor’s May Revise for the state budget and the possible increase of the deficit. Supervisor Tryon on Wednesday evening will attend a COG meeting.
b) Supervisor Claudino had nothing to report.
c) Supervisor Callaway on Wednesday evening will attend a COG meeting; on Thursday will attend a Area 12 Agency on Aging and a Central Sierra Child Support meeting; Friday morning will attend a jail meeting.
d) Supervisor Thomas, today, will attend a Mental Health Board meeting as an alternate; on Wednesday will attend a meeting of the Central Sierra Economic Development Agency; on Friday will attend a jail meeting.
e) Chair Wilensky today, will attend a Mental Health Board meeting; on Thursday will attend a Central Sierra Family Support meeting; Chair Wilensky reported on comments that have been stated to him by citizens and County personnel regarding locating County Departments. This involves the lack of signs or map locators which conveys to the public difficulties in accessing public offices.
Chair Wilensky expressed concerns for the ongoing issue for the late arrival of documents being submitted for the Boards review for agenda items as well as study sessions. Chair will not be attending the Board meeting of February 12th.
f) Supervisor Callaway expressed the desire to have large documents, such as EIR’s, submitted with more than a week for evaluation.
g) CAO Lawton has toured County Departments and the jail.
h) County Counsel Jones had nothing to report.

CLOSED SESSION : CONFERENCE WITH REAL PROPERTY NEGOTIATORS; PURSUANT TO GOVERNMENT CODE SECTION 54956.8; Property APN’s as follows: 44-011-050, 44-011-051, 44-011-049, 44-011-052; Agency negotiator; Brent Harrington or alternate to be determined; Negotiating parties: Ryan Voorhess, Greg Opinski; Under negotiation: instruction to negotiator regarding potential purchase, price, financing options; County Counsel/Administration – Board action: nothing to report
Discussion re: Well Ordinance; Environmental Management Agency was cancelled
Discussion re: Air Pollution Control Board Update. Brian Moss, Administrator, Environmental Management Agency, made a brief presentation. Lakhmir Grewal, Air Pollution Control Officer, made comments regarding the hiring process and expressed an urgency to hire a temporary permit technician as the Air Pollution Control District(APCD)Burn Program was adding burden on Agriculture and the APCD staff.
The Board authorized the hiring of a full time temporary as soon as possible and directed staff to bring the matter before the Board for budget adjustment.
