8.PUBLIC COMMENTS: Nik Tali, Lake Tulloch, expressed concerns regarding this summer’s short term rentals for the impact on the residents of his neighborhood and the lake. Tali would like to have a solution for this situation. Reference was made to this past week-end’s phone calls to the sheriff’s Department for situations that occurred on the lake. Tali asked if the Sheriff’s representative could stay longer at the lake.






08/26/2008 SUMMARY

Joyce Techel, business owner and resident of the Valley Springs area, spoke with concerns regarding an appeal of the Planning Commission decision to not allow billboards in the area. Ms. Techel asked the public to voice concerns to the Board of Supervisors to support the Planning Commissions decision.
Laura Sternick, Copperopolis nursery owner, spoke with concerns regarding the parking lot for her business. She would like to have a variance to be able to place pavers instead of asphalt due to concern about the environment. Supervisor Thomas will meet with her and Public Works to determine how this issue can be addressed.
Darren Borgedalen, resident of Struckman Road, stated difficulties he has experienced in obtaining building permits. Reference was made to his ongoing issue with the County regarding road easements. Interim Community Development Director John Taylor, give a status report for Borgedalen’s building permit. Taylor stated that there has been no response by the applicant for documents that were requested on December 19, 2007.
Borgedalen responded to the report stating he has submitted his documentation. Chair Thomas asked Borgedalen to discuss these concerns with Taylor.
Lakhmir Grewal, Air Pollution Control Officer, reported to the Board regarding the Carl Moyer Program funding. At this time $100,000 has been received and the balance will be forthcoming in two months. Applications have been received for funding with encouragement given for other submissions which would assist with diesel engine installations or improvements.
Grewal stated that there is 1.3 million dollars set aside for the County school bus program that will be distributed to Calaveras and Bret Harte school districts.
9.Discussion and possible action re: RESOLUTION proclaiming September 2008 as Recovery Happens Month in celebration of persons in recovery living sober; Behavioral Health - Board action: approved 4-0-1 Absent: Wilensky

11.PUBLIC HEARING and possible Board action re: RESOLUTIONS (2) establishing an agricultural preserve and CALIFORNIA LAND CONSERVATION CONTRACT NO. 290 for: Sidney Weinstein and Randall J. Nathan; Department of Agriculture - Board action: approved 4-0-1 Absent: Wilensky
12.PUBLIC HEARING and possible Board action re: 2001-110 Zoning Amendment, revised Conditional Use Permit and addendum to the Environmental Impact Report (EIR) for California Asbestos Monofill, Inc. (CAM) to make certain changes to permitted disposal operations in the former asbestos mine pit located in southwestern Calaveras County. The requests retain substantially similar operations as permitted today, and include (1) local land use regulation designation changes; and (2) use permit modifications to clarify types and methods of waste handling and disposal. The project concerns technical topics that were vetted with responsible public agencies, including the California Integrated WasteManagement Board (CIWMB). Though not required under CEQA, responses to comments on the EIR addendum (the final EIR addendum) are being circulated to the public prior to the Planning Commission's hearing on the project. The Final EIR addendum identifies no new environmental impacts. The project site is located approximately 40 miles east of Stockton on a 676.5 acre site, approximately five miles southeast of the town of Copperopolis off O'Byrnes Ferry Road between State Route 4 and State Route 108. The existing General Plan designation is Mineral Resource Area 2A (MRA-2A) while the zoning districts are General Agriculture (A1) and Unclassififed (U). Zone change is to General Industrial (M2), consistent with existing industrial uses of the property. (APN's 064-027-02, 064-027-06, 064-028-11, 064-028-14, T1N, R13E, Sec. 15, 16, 21 and 22); Community Development Agency - Board action: approved as modified 4-0-1 Absent: Wilensky
13.Review of correspondence, reports and various matters of concern. Supervisor Callaway stated that today marks the 88th year that women received the right to vote by the 19th amendment of the Constitution. Supervisor Callaway encouraged all women to exercise this freedom by voting in the upcoming election in November. Supervisor Callaway, this evening, will attend an 88th anniversary of woman’s right to vote dinner; Wednesday will attend a Fish and Game Commission meeting, Thursday a jail meeting and a Juvenile Justice Commission meeting; this week-end will be attending the annual Logging Jamboree in White Pines.
Supervisor Claudino on Saturday will attend a community event at the Jenny Lind Veterans Memorial Building in Valley Springs.
Supervisor Tryon reported on an RCRC meeting he attended last week in Sacramento. Discussion was held at the meeting regarding the State

budget concerns. It is felt that budget discussions will continue for some time. The Governor has items to be placed on the November ballot which will be known soon, as the election deadlines approaching. The controversy with the Governor and the State Controller concerning paying State employees was a topic of discussion at the meeting.
Supervisor Tryon attended the Planning Commission meeting on Thursday. Reference was made regarding the owners of the Murphys Hotel taking down a tree and placing a neon sign in the County right of way. The removal of a historic sign would also be part of this process. Supervisor Tryon would like to have this issue brought to the Board as this could have implications for other historical districts to have neon sign placement.
Supervisors Callaway and Claudino concur with Supervisor Tryon in bringing this item for Board consideration with Supervisor Thomas not in favor. Supervisor Thomas supports the process of the Planning Commission and supports their determinations.
Supervisor Thomas will attend the Copperopolis Community Planning meeting on Thursday; on Saturday will address the Poker Flat Home Owners Association meeting.
CAO Lawton had nothing to report.

County Counsel Jones had nothing to report.
