Letter to the Editor: Calaveras County’s EVCS Ordinance - Repeal and Replace. ~ Christopher Buttner

Murphys, CA...My name is Christopher Buttner and I have been a full time resident of Murphys since mid-2015. I am the son of a firefighter. I have over three decades of experience in event safety protocols for arenas, amusement parks, convention centers, and cruise ships.




The Butte Wildfire of September 2015 was a PG&E causation. PG&E has been blamed for more than 30 wildfires since 2017 that destroyed over 23,000 homes and businesses and killed over 117 people.

I have grave concerns shared by many in Calaveras regarding the public safety and extreme fire risk posed to the Arnold community by the Tesla Supercharger Station under construction in the northwest corner of Arnold’s Meadowmont Center, following the hastily approved Electric Vehicle Charging Station (EVCS) permitting process six years ago.

There is considerable acknowledged value in Calaveras County attracting and integrating “green” EVCS infrastructure. A properly sited, reviewed, inspected and approved Tesla Supercharger Station is a very desirable addition to Arnold. Regrettably, the poorly selected siting of the facility on the parcel presents multiple public safety concerns that were left unaddressed by the fast-track ministerial permit approval.

On July 25th, I submitted a detailed nine-page written analysis about this Tesla Supercharger station to the Calaveras Board of Supervisors.

Points of concern include the permit process conditional exclusion of fire officials from participation in the review and approval of this high-risk facility, the proximity of this facility to residences, trees, large capacity propane tanks, and unregulated traffic.

The root cause of this problem extends back to January 24, 2017, when a flippantly discussed and unanimously approved agenda item for the EVCS Ordinance was introduced.

Supervisors Tofanelli, District 1, and Garamendi, District 2, voted to approve the EVCS Ordinance. The video record of the ordinance approval process is a shameful and lasting indictment of the continuing failure of this county’s government to recognize and anticipate risk to public safety before its citizen’s insist.

A high-risk EVCS is now under construction. The community insists upon a temporary injunction until a thorough review by fire officials, law enforcement and public works has occurred to mitigate the risk and assure the community of public safety.

Further, the EVCS Ordinance must be repealed and replaced to insert fire officials in the permitting and approval process for all non-residential EVCS installations.

A detailed EVCS Repeal and Replace Ordinance request was emailed to the Calaveras County Board of Supervisors, and the Calaveras County Planning and Building Departments, on behalf of the Citizens of Arnold and Calaveras, on August 7, 2023, and I addressed this to the Calaveras County Board of Supervisors during General Public Comment period on the morning of August 8, 2023.

    Can you provide data to demonstrate how these chargers (which you seem to call high-risk based on your own assessment) compare to petrol stations? Or provide information about past public safety risks proven? With thousands of these chargers across the country, they should be a lot of data to support your view that these are dangerous. But I just did a search and can't find any evidence that superchargers are any more dangerous than any other major electrical installation (factory, for example.)

    Ill be honest - on the surface this feels like a hit piece against the EV industry. But if you have empirical data to support your views, I'd like to see it.

        The website calls for more police, fire, and other services. Pro, Pro business, tourism, and economic development.
        Murphys is not the economic engine of the county, a contributor, yes.
        The main tax base is Valley Springs, and Copperopolis .
        This is where the main tax revenue comes from.
        So their taxes must be raised as elsewhere.

        I like the county as it is , I don't wish to lose the ambience of the county as is, not more congestion with development.

        If you don't like the county with it's diverse political views, you are entitled to that view.
        The supervisors are voted in, they reflect the will of the people.

        There will be a political tsunami in 2024 , Democracy will restore our rights,and representation , and the rule of law by the vote where all legal voters can vote.

      So I don’t know this guy, however there is something to think about.
      Calfire allowed the Butte Fire to enter Calaveras County and mismanaged the local state and local government resources. They are equally negligent regarding that fire and others. Yes PG&E is enormously responsible but so is Calfire!

      EV’s are catching fire on the road, at residents, in parking lots and garages as well as charging stations across the country.
      Fires Depts are in many cases unable to extinguish the fires. In addition the smoke from the vehicles is incredibly toxic to firefighters and the public. More toxic then gas powered vehicles. Fire Depts are attempting to figure out how to handle these fires but to date still don’t have a clear path.

      To the comment above regarding concern for grandchildren’s future. EV’s require many minerals that are being removed from the earth in an unregulated manner with enormous damage to what, the earth and environment. Who is profiting from EV production? Our biggest threat to our grandchildren, China!
      And lastly gas stations have clearance from pumps to structures with safe guards. Not in clove proximity to other structures. It is also negligent not to have Fire Dept’s involved with the permit process.

This broad, sweeping statement most certainly must be easy to back up with news articles (not from some whackjob/astroturf site), video footage (who wouldn't capture their car spontaneously combusting on film?), examples of the inevitable lawsuits, etc. IF it were true.

        "Research" isn't clicking a bunch of links on sites of people who think like you (or are telling you how to think). Saying something repeatedly and confidently is not the same as it being true. This kind of thought(?) process makes the "arguments" of half the country dismissable, and then they get butthurt that their unassailable, "my gut is just as good as some elite with an education on the subject" arguments are being ignored. Just think before you scream, unless you *want* to sound like you're Butner.
